The COVID-19 public health emergency (PHE) will expire May 11. The Centers for Medicare & Medicaid Services (CMS) has provided detailed answers to frequently asked questions related to the end of the PHE and its associated healthcare flexibilities.
The ACR also reminds members that the Consolidated Appropriations Act of 2023 extended most telehealth flexibilities through Dec. 31, 2024. This includes geographic originator flexibilities, including audio-visual and most audio-only visits. With the expiration of the PHE, all telehealth visits must comply with HIPAA-compliant telehealth platforms, and cross-state line licensure will depend on the state. Some states have outlined what is and is not permissible after the PHE. Refer to specific state requirements for more information on flexibilities and cross-state licensing requirements.
